A trucking company is facing a lawsuit after one of its truck drivers rear-ended a vehicle because the tractor-trailer was allegedly traveling too fast to brake.
Gwendolyn Castle filed suit against White Marsh Transport Inc. on March 3 in federal court in New Orleans.
The collision occurred on Sept. 29, 2010 on U.S. Highway 90 when Castle was driving her vehicle and defendant's truck struck the vehicle from behind.
The defendant is accused of negligence for failing to yield the right of way, failing maintain a proper lookout and proper control of his vehicle, failing to timely brake or otherwise maneuver the vehicle to avoid the collision, failing to operate the vehicle in a reasonable and prudent manner and in obedience of traffic laws and regulations and driving too fast.
The defendant is also accused of negligent entrustment.
The plaintiff is seeking damages for physical pain and mental anguish, lost earnings, loss of earning capacity, disfigurement, physical impairment, medical expenses, loss of enjoyment of life, loss of household services, property damage, court costs, interest and exemplary damages.

U.S. District Judge Lance M. Africk is assigned to the case.
