Shopper claims emotional distress after slip and fall incident

A Wal-Mart shopper is suing the store for emotional distress after he slipped in a liquid substance while walking down the pet food aisle.

Jeffery Anderson and Leola Anderson filed suit against Wal-Mart Inc. and ABC Insurance Co. on March 24 in St. John the Baptist Parish District Court. The defendant removed the case to federal court in New Orleans on June 17.

The accident occurred on June 9, 2010 at the Wal-Mart in La Place as Jeffery Anderson was shopping in the pet food aisle and slipped in a liquid substance. He states he injured his side, ankle, back and arm in the incident.

The defendant is accused of failing to ensure a safe and non-hazardous shopping environment, failing to attend to spillage in a timely manner, failing to place obstacles that would provide warning to patrons for safe passage and failing to ensure that premises in its entirety was conducive to its patrons.

The Anderson are seeking damages for physical pain and suffering, mental pain and suffering, emotional distress, medical expenses, loss of consortium, interest and court costs.

The plaintiffs are represented by Ernestine L. Anderson-Trahan and Clifton M. Davis, III of Law Offices of Trahan & Davis in New Orleans. A jury trial is requested.
