A New Orleans man is seeking damages after he broke his hip when he fell into a hole while riding across the lawn of a Family Dollar located on Claiborne Avenue in New Orleans.
Clarence McGee filed a suit that says the hole was covered with grass when he unknowingly rode his bike over it and fell five to 10 feet.
McGee filed suit against Family Dollar Stores of Louisiana for severe and debilitating injuries connected to the fall. The suit alleges Family Dollar allowed a dangerous situation to exist and failed to correct it, which resulted in McGee's injuries.
The suit seeks an unspecified amount for damages related to medication, hospitalization, medical care, loss of wages, loss of earning capacity, pain and suffering, residual disabilities, mental anguish, emotional upset and distress, loss of enjoyment of life, rehabilitation and support care.
McGee is being represented by Benjamin J. Birdsall of Birdsall Law Firm in New Orleans.
