Woman sues pharmacy after stepping in hole

NEW ORLEANS – A woman has sued a Metairie pharmacy after she fell when she stepped in a hole in the stores parking lot.

Ruth Trayal was exiting C's Discount Pharmacy at 14021 Veterans Blvd. in Metairie and stepped in a hole in the parking lot between the curb and drain.

The plaintiff's case asserts her fall resulted in a fractured right thumb, a fractured right big toe, herniated discs in her back, aggravation of back osteoarthritis, internal derangement and contusion of the right shoulder, occipital headaches and aggravation of degenerative disease of spine.

Trayal filed suit on Dec. 8 in the Orleans Parish Civil District Court.

The pharmacy is being held liable for negligence related to failing to repair the hole, failure to properly inspect the parking lot, failure to place caution signs near the hole and failure to warn plaintiff of danger.

Unspecified damages sought include medical expenses, lost wages, loss of earning capacity, pain and suffering, emotional stress and strain, loss of enjoyment of life and permanent residual disability.

The suit is brought on behalf of Trayal by Darleen M. Jacobs of New Orleans and Kenny M. Charbonnet of New Orleans-based Charbonnet Law Firm.

Case number 2011-12756 has been assigned to Division L Judge Kern A. Reese.
