Academy Sporting store sued after customer slips in water

A Lafourche Parish resident has filed a personal injury lawsuit against Academy Sporting and Outdoor Store after he slipped in water and suffered injuries.

Darrell James Buggage filed suit against Academy Ltd. and Zurich Services Corp. on Nov. 23 in East Baton Rouge Parish District Court.

The defendant removed the case to federal court in New Orleans on Dec. 28.

Buggage states he was injured on Nov. 26, 2010, as he was entering the store in Baton Rouge. According to the complaint, he slipped in a puddle of water on the floor and injured his knee and back.

The plaintiff claims that there were no "wet floor" signs posted.

The defendants are accused of breaching a legally imposed duty of care, breaching its duty to protect customers from foreign substances on the floor, failing to take reasonable protective measures in order to keep the floors free of substances that can cause customers to fall and failing to see what should have been seen.

The plaintiff is asking for an award of damages for physical and mental pain and suffering, lost wages, medical expenses, interest and court costs.
