DONALDSON - An Ascension Parish man is suing a fertilizer company for burns he claims to have suffered while working as a contractor.
Levelt Myles filed suit on Dec. 28 in the 23rd Judicial District against Mosaic Fertilizer.
Myles claims he received severe burns to his foot when he stepped into a trough of hot water and acid while trying to troubleshoot a piece of equipment that was boiling over and leaking the substance. The plaintiff claims that both Mosaic as the property owner and co-defendant James Construction Group are responsible for the removal of a grating that ordinarily covered the trough.
An unspecified amount in damages is sought by Myles for medical expenses, lost wages, permanent scarring and disfigurement and other general damages. Myles asserts the defendants were negligent in not providing a warning of the hazard, not properly supervising employees, creating an unreasonable risk, improper maintenance of equipment and failing to fix a problem that resulted in the incident.
Myles is being represented by John P. Wolff of Baton Rouge-based firm Keogh, Cox and Wilson.
The case has been assigned to Division C Judge Guy Holdridge.
