NEW ORLEANS - A man is suing his former employer for terminating his employment after he settled a workers' compensation claim with a property holding company.
Kenneth Johnson filed suit in Orleans Parish Civil District Court on Dec, 22 against Manhattan Management Company.
Johnson claims he filed a workers' compensation claim against his employer, alleging he was cutting wood when a splinter got into his eye and resulted in an infection that preceded his workers' compensation claim.
The case asserts it is against state law for an employer to terminate an employee due to a workers' compensation claim. The filing states Johnson worked for Manhattan for two years and three months following the incident and was immediately released from the job after his claim was settled.
Johnson is seeking a civil penalty reward and reimbursement for attorney's fees and court costs.
New Orleans-based attorney William S. Vincent is representing Johnson.
The case has been assigned to Division L Judge Kern A. Reese.
