NEW ORLEANS - The family of a deceased man is suing a nursing home for allegedly not giving him vital medication weeks after a critical emergency.
The family of Milton Aucoin filed suit on Jan. 9 in the Orleans Parish Civil District Court against long-term care facility Chateau De Notre Dame.
The filing alleges Aucoin was recovering from a stroke that occurred weeks before and was released into the care of the Chateau. The nursing home is alleged to have kept Aucoin for two days without giving him blood-thinning medication critical to ensure another stroke would not occur.
The plaintiff claims the defendant withheld the blood-thinner and 19 other medications, which led to a subsequent stroke and Aucoin's death 10 days later. The filing also claims the Department of Health and Human Services surveyed the facility's medication records and found unacceptable medication error rates. The plaintiff alleges the medication errors were a long-term issue for the facility spanning back to at least 2007.
An unspecified amount in damages is sought by the family from Chateau for improper treatment, untimely treatment, failing to manage care correctly, failing to obtain lifesaving medications, failing to provide alternative measures and failing to be free of medication errors.
The Aucoins are being represented by Michael S. Bradner of New Orleans-based Bialous Law Firm.
The case has been assigned to Division C Judge Sidney H. Cates.
