NEW ORLEANS – A Jefferson Parish man is suing a janitorial company for injuries he sustained at work when he slipped on a floor that had just been mopped.
Jimmy Hernandez filed suit on Jan. 20 in the Orleans Parish Civil District Court against Empire Janitorial Sales and Service.
Hernandez claims he was working as an engineer at the Ernest N. Morial Convention Center in New Orleans when the defendants cleaned the floor of his workspace.
Hernandez alleges he finished up his work and was leaving the room when he slipped on a liquid the defendants spread on the floor and fell. The plaintiff also claims he was lifting himself from the first fall when he slipped and fell again on the substance and received personal injuries to his shoulders, hands, elbows and back.
The defendant is accused of not warning of the dangerous condition, failure to place caution signs around the dangerous area, failure to insure the safety of others and failure to use reasonable vigilance.
An unspecified amount in damages is sought for pain and suffering, medical expenses and loss of income.
Hernandez is being represented by Charlsey Wolff of New Orleans-based Wolff and Wolff.
The case has been assigned to Division H Judge Michael J. Bagneris.
