NEW ORLEANS – A New Orleans woman is suing a local levee board for allowing commercial development next to her boathouse residence.
Joan C. Rogers filed suit on Feb. 8 in Orleans Parish Civil District Court against the Board of Levee Commissioners of Orleans Levee District.
The plaintiff claims she leased her boat slip from the defendants under the condition that any development at the adjoining slip would be residential. Rogers alleges the board breached her 1996 lease when they authorized the building of a restaurant in the slip in question. The plaintiff also claims she rejected an offer by the developers to include her boathouse as part of the development.
Rogers is seeking to stop the commercial activity at the adjoining boat slip, halt any construction work done on the slip that is not residential and get a permanent injunction against the defendants.
The plaintiff is being represented by attorney John A. E. Davidson of Metairie.
The case has been assigned to Division N Judge Ethel S. Julien.
