GRETNA – A Jefferson parish woman is suing a local hospital for charges she claims were unwarranted.
Nell Ladieux is the named party in a proposed class action lawsuit filed on Feb. 3 in 24th Judicial District Court against East Jefferson Parish Hospital.
Ladieux claims she was treated at the hospital for injuries she received in a car accident. She claims she had health insurance and that the hospital charged in excess of the contracted insurance reimbursement rate. The plaintiff asserts she was forced to remit payment after the hospital refused to submit a claim to her insurer.
The class action has been separated into two subclasses: "attempt to recover" where the hospital tried to recover from the patient in excess of the amount reimbursed by the insurer and "payor" where the patient paid the amount in excess of reimbursement.
Damages sought include reimbursement from the hospital for payor subclass and a judgment declaring the hospital should attempt to recover from the insurer any charge over the agreed upon reimbursement rate.
Ladieux is being represented by Sidney Torres III.
The case has been assigned to Division I Judge Nancy A. Miller.
