Woman sues store claiming she received injuries when display fell on her

Robert B. Evans

GRETNA – A Jefferson Parish woman is suing a Harahan retailer for injuries she claims happened on their premises.

Carla Jewell filed suit on Feb. 17 in 24th Judicial District Court against Cost Plus World Market and its insurer.

Jewell claims she was in an aisle at the store and looking at items on one of the lower shelves when a large store display frame fell on her head from above and was followed by four to five other objects that fell on top of her.

The plaintiff alleges she was injured in the incident directly due to the hazardous display. Jewell accuses the defendants of failing to maintain a safe place of business, allowing the wall displays to become dangerous, failure to warn of the danger, failure to protect the plaintiff and failure to keep premises safe.

An unspecified amount in damages is sought for physical pain and suffering, mental anguish, disability, medical expenses, loss of enjoyment of life, loss of use of parts of the body, bodily disability, impairment of psychological functioning, disability from engaging in recreation, destruction of earning capacity, loss of support, loss of society and loss of consortium.

Jewell is being represented by Robert B. Evans, III of New Orleans-based Burgos and Evans, LLC.

The case has been assigned to Division D Judge Robert M. Murphy.
