Slip and fall lawsuit filed against Winn-Dixie

NEW ORLEANS - Winn-Dixie is being sued after a shopper allegedly slipped and fell due to a wet grocery store floor.

Rick R. Robin and Susan M. Robin filed suit against Winn-Dixie Montgomery and XYZ Insurance Co. on Jan. 30, 2010 in St. Bernard Parish District Court. The defendant removed the case to federal court in New Orleans on Feb. 27.

The incident occurred on Sept. 3, 2011 while Susan Robin was shopping at the Winn-Dixie located on Parish Road in Chalmette. She states that she slipped and fell because of the wet grocery store floor.

The defendants are accused of negligence for failing to take all precautions to avoid this casualty, failing to warn customers of the dangerous conditions, failing to take precautions such as cleaning up the water from the floor, failing to properly inspect the floors and entrance of its grocery store, failing to re-route traffic away from the hazard of the soaking wet floor despite knowledge of the presence of all the water on the floor, and knowingly diverting the attention of and distracting customers with product displays.

Represented by Chalmette attorney Dan A. Robin, the plaintiffs are asking for more than $75,000 in damages. A jury trial is requested.

U.S. District Judge Kurt D. Engelhardt is assigned to the case.
