Chevys Fresh Mex sued for slip and fall

NEW ORLEANS – A Jefferson Parish man is suing a local restaurant for injuries he claims occurred on the restaurant's premises.

Joey P. Griffin filed suit on Feb. 24 in Orleans Parish Civil District Court against Southeast Restaurant Development, LLC, Chevys Fresh Mex, Pete Lewis and their insurer.

Griffin claims he was using the bathroom at the Chevys Fresh Mex located at 3330 Veteran's Boulevard in Metairie when he slipped and fell in standing water in the establishment's bathroom.

The plaintiff alleges he suffered injuries due to the fall including muscle strains, trauma to his right elbow, trauma to his left forearm, lumbar strain, a rotator cuff injury that required surgery to repair, herniated and ruptured discs in his spine, right elbow damage, dizziness, headaches and emotional upset and distress.

The defendants are accused of negligence for failing to correct a hazard, creating or knowing of a hazard, failing to provide safe conditions for customers, failing to maintain the premises in a safe condition, failing to inspect and maintain restrooms, failing to exercise reasonable caution and failing to warn of the hazard.

An unspecified amount in damages is sought for medical costs, pain and suffering, residual disabilities, mental anguish and emotional upset.

Griffin is being represented by New Orleans-based attorney Michael L. Rodriguez.

The case has been assigned to Division F Judge Christopher J. Bruno.
