Pool company sued over allegedly faulty repair

DONALDSONVILLE – An Ascension Parish man is suing a pool repair company claiming they failed to perform work to the standards of their contract.

Charle F. Mitchell filed suit against Emerald Pools LLC on March 2 in the 23rd Judicial District Civil Court.

Mitchell claims he contracted Emerald Pools to remove the plaster in his pool and replace it with a new plaster finish. The plaintiff says the defendant did the job and was paid in the amount of $19,917. However, Mitchell alleges the plaster in the pool began to deteriorate immediately after the job and that a large hole developed in the side of the pool.

The plaintiff claims he has made several demands for Emerald Pools to fix the problem, but the defendant has made no attempt to remedy the problem or bring the pool to the standard agreed upon in the original contract, according to the lawsuit.

Damages sought include the $19,917 contract price paid to the defendant, the cost of repairs to the pool and damages for the property damage.

Mitchell is being represented by Robert G. Jackson of Baton Rouge-based firm Jackson and Jackson.

Case number 102973 has been assigned to Division D Judge John L. Peytavin.
