NEW ORLEANS – A New Orleans woman is suing a local grocery store for injuries she claims were incurred on their premises.
Glynder Robertson filed suit on March 4 against Winn-Dixie and its employees in Orleans Parish Civil District Court. Robertson claims she was walking in the store when she slipped and fell in a puddle.
The plaintiff alleges the fall resulted in the plaintiff breaking her left hip which required two surgeries to correct. Robertson claims there were no signs placed in view to warn of the slippery floor and that the condition was the result of the store's employees not cleaning up the puddle. She asserts the store's employees were amusing themselves by laying in wait and watching the plaintiff slip and fall.
The defendants are accused of failing to warn of hazards, not inspecting the store properly, not maintaining a trafficked area, disregarding the safety of customers, not providing a safe means to traverse the floor, failing to maintain the premises free of defects, failing to remedy defects, knowing of the hazardous condition without fixing it, not maintaining policies to keep the floor mopped and dried, not abiding by their own maintenance policies, failing to properly supervise employees, creating a dangerous situation and intentional and careless conduct.
An unspecified amount in damages is sought for pain and suffering, mental anguish, medical expenses, loss of enjoyment of life and physical disability.
Robertson is being represented by New Orleans-based attorney Stephen M. Smith.
The case has been assigned to Division A Judge Tiffany G. Chase.
