Cucos Mexican Cafe sued by man after chair allegedly collapses

Charbonnet Jr.

GRETNA – A Jefferson Parish man is suing a local restaurant claiming the chair he sat in collapsed beneath him.

John Dazet filed suit on March 26 against Cucos Mexican Cafe in the 24th Judicial District Court.

Dazet claims he went to sit in a metal chair on the restaurant's patio and it immediately collapsed underneath him as he sat down. The plaintiff alleges he was injured in the fall and notified the bartender of the incident. The defendant is accused of allowing a dangerous condition to exist on its premises, failing to warn the plaintiff about the chair, failing to take proper action to fix the defective chair and failing to properly inspect the premises.

An unspecified amount in damages is sought for medical expenses, mental anguish, pain and suffering, wage loss, property damage, transportation expense, loss of enjoyment of life and loss of earning capacity.

Dazet is being represented by Robert P. Charbonnet, Jr. of Metairie-based Charbonnet Law Firm.

The case has been assigned to Division H Judge Glenn B. Ansardi.
