NEW ORLEANS – A New Orleans woman is suing for damages she claims she received in a fall on a local restaurant's premises.
Geraldine Rhodes filed suit on April 3 against Port of Call, Inc. and its insurer in the Orleans Parish Civil District Court. Rhodes claims she was visiting the Port of Call restaurant on Esplanade Avenue in New Orleans when she fell as she was descending the stairs.
The plaintiff asserts she was reaching for the handrail and when finding none twisted and fell backwards on the concrete and hit her head.
Rhodes alleges the restaurant's stairs were in poor condition, unevenly worn, uneven in rise, hand no handrail and were not compliant with applicable building code. The defendant is accused of having knowledge of the danger the stairs posed and failing to exercise reasonable.
An unspecified amount in damages is sought for pain and suffering, medical expenses, mental anguish, property damage and loss of enjoyment of life.
Rhodes is being represented by Jennifer Willis of New Orleans-based Willis and Buckley, APC.
The case has been assigned to Division I Judge Piper D. Griffin.
