NEW ORLEANS - After slipping and falling, a Jefferson Parish resident has filed a lawsuit against a home improvement store for failing to warn customers of a dangerous condition on its sales floor.
Troy Wayne Leggett originally sued Lowe's Home Centers Inc. last year in Jefferson Parish District Court. The defendant removed the case to federal court in New Orleans on April 25.
While shopping at the Lowe's Home Center located in Harvey, Leggett states that he slipped and fell on a clear liquid substance that was accumulating on the sales floor area.
The alleged incident occurred on April 13, 2011.
Lowe's is accused of negligence for failing to properly inspect, maintain and warn of the dangerous and defective condition of the area, failing to timely inspect and clean up the sales floor areas, failing to warn customers of the condition of the sales floor area, failing to safely maintain the area in a reasonably safe condition, in creating or maintaining a dangerous or defective condition, and for failing to properly train their employees regarding the proper procedures of cleaning of spills.
The plaintiff is asking for an award of damages for pain and suffering, permanent damage to his person, loss of enjoyment of life, medical expenses, economic damages, fees, and court costs.
Leggett is represented by Gretna attorney Pierre F. Gaudin.
U.S. District Judge Sarah S. Vance is assigned to the case.
