GRETNA – A Jefferson Parish man is suing a daiquiri bar for injuries he claims he sustained on its property.
Daryl Mercante file suit on June 6 against Freeze, Inc. and New Orleans Original Daiquiris.
Mercante claims he was a patron at New Orleans Original Daiquiris at 3301 Veterans Boulevard in Metairie on October 31, 2011 during a Halloween party and while walking through the parking lot he slipped on a bottle that had been discarded on the ground and fell and injured himself. The plaintiff alleges customers were allowed to take glass containers into the parking lot.
The defendant is accused of failing to warn of a dangerous condition, failing to inspect and maintain the premises, failing to provide a safe path on its premises, allowing trash to be discarded on the property and allowing a hazardous condition to exist.
An unspecified amount in damages is sought for medical expenses, pain and suffering, mental anguish, physical disability, physical disfigurement and scarring, loss of enjoyment of life, loss of wages and loss of earning capacity.

The case has been assigned to Division D Judge Robert M. Murphy.
