NEW ORLEANS - Claiming she is now suffering from kidney problems, a Thibodaux woman has filed a lawsuit against the manufacturers of the prescription drug Zocor, a cholesterol lowering medication.
Danielle Woolens filed suit against Merck & Co Inc., Schering-Plough Corp. and Merck/Schering-Plough Pharmaceuticals, Lupin Pharmaceuticals, Teva Pharmaceuticals Inc., Dr. Reddy's Laboratories Inc., and Ranbaxy Laboratories Inc. on June 1 in federal court in New Orleans.
Zocor is the brand name of the drug simvastatin.
Woolens states that the drug is defective, dangerous to human health, unfit and unsuitable to be marketed and sold, and lacked proper warnings as to the dangers with its use.
She took the drug for cholesterol for approximately 10 years. In August 2010, she suffered kidney failure, the suit says.
The defendants are accused of providing a product that is unreasonably dangerous in construction or composition, in design, due to inadequate warnings about the product and because of nonconformity to express warranties.
The plaintiff is asking the court for an award of damages for physical injuries, mental anguish, pain and suffering, loss of enjoyment of life, lost wages, lost earning capacity, medical expenses, medical monitoring, embarrassment, humiliation, fright, apprehension, emotional distress, disability, interest, court costs, and attorney's fees.
Woolens is represented by Michael Hingle, Ronald J. Favre, and Bryan A. Pfleeger of Michael Hingle & Associates in Slidell. A jury trial is requested.
U.S. District Judge Mary Ann Vial Lemmon is assigned to the case.
