NEW ORLEANS – A New Orleans-based church has been targeted by a federal nutrition assistance program for not serving milk with lunches served through a food program.
The State of Louisiana and Department of Education Division of Nutrition Support filed suit against the Upper Room Bible Church and Herbert H. Rowe, Jr. in the New Orleans Civil District Court on June 12.
The State claims the Church defendants were unable to prove they had served milk with lunches that they requested reimbursement for from the Federal Summer Food Service Program.
During June 2009 the defendants claimed they served 1,124 meals under the program and received a reimbursement of $10,810.47, however, they submitted the same receipts for milk for both June and July 2009.
The defendants are accused of failing to meet stipulations to the agreement to participate in the food program.
Damages are sought for the amount of $10,810.47 plus collection costs, attorney's fees and related court costs.
The plaintiff is represented by Assistant Attorney general with the Louisiana Department of Justice J. Andrew Murrell.
The case has been assigned to Division A Judge Tiffany G. Chase.
