GRETNA - A recreation rental company is suing a Georgia couple for breach of contract for allegedly violating a non-compete clause.

The Inflatable Zoo, Inc. and Space Walk filed suit against Michelle R. Smith, Stephen D. Smith and Outrageous Events, Inc. in the 24th Judicial District Court on June 25. The plaintiff claims the defendants entered into an agreement to promote and sell the plaintiff's services in the East Atlanta, Ga. metro area. The Smiths are accused of prematurely terminating that contract, which included a non-compete clause, and starting their own competing business from which the plaintiff received no payment.

The defendant is accused of violating a non-compete clause and infringing on the plaintiff's trademark.

An unspecified amount in damages is sought plus legal interest, attorney's fees and cost of proceedings.

The plaintiff is represented by attorney Stephen K. Conroy of Metairie.

The case has been assigned to Division N Judge Hans J. Liljeberg.
