Westin being sued by woman who fell on pool deck

Jeffrey C. Cashe

NEW ORLEANS – A Tangipahoa Parish woman is suing a hotel for injuries she claims to have received on its premises.

Sandee Hinton filed suit against Starwood Hotels & Resorts Worldwide, Inc. and their insurer in the Orleans Parish Civil District Court on June 25.

Hinton claims she was staying at the Westin Hotel in New Orleans when she was crossing the walkway between the pool and the ladies restroom and she tripped on uneven boards and fell. The plaintiff alleges she received extensive damage to her shoulder, knee, wrist and chest.

Hinton assets that she received first aid from hotel staff and later from an after hours urgent care facility where she received injections into her knee.

The defendant is accused of failing to properly maintain a highly traveled area, failing to insure all boards were properly affixed, having knowledge of a dangerous and hazardous condition without attempting to remedy it and failing to oversee and implement appropriate safety measures.

An unspecified amount in damages is sought for physical pain and suffering, mental pain and suffering, anxiety, nervousness, depression, loss of enjoyment of life, medical expenses and loss of income.

Hinton is represented by Jeffrey C. Cashe of Hammond-based Cashe, Coudrain & Sandage.

The case has been assigned to Division A Judge Tiffany G. Chase.

Case no. 2012-06234.
