Lumber Liquidators sued by man who claims employees dropped items on him from a forklift

GRETNA – A St. Tammany man is suing a Jefferson Parish home improvement center for injuries he claims to received in a forklift incident.

Thomas Pettigrew filed suit against Lumber Liquidators, an anonymous employee and their insurer in the 24th Judicial District Court on July 2.

Pettigrew claims he was shopping at Lumber Liquidators located at 5605 Salmen Avenue in Harahan when he was thrown several feet to the ground after being struck by metal extensions that flew off of a forklift being operated by a store employee. The plaintiff alleges he suffered severe and disabling injuries in the incident.

The defendant is accused of failing to maintain a safe place for visitors, failing to take necessary measures to protect the safety of visitors, failing to properly maintain and inspect premises, failing to properly train and supervise employees, failing to warn visitors and workers of dangerous premises and failing to take steps to avoid the incident.

An unspecified amount in damages is sought for physical pain and suffering, mental pain and suffering, rental expenses, property damage, depreciation of vehicle, loss of earning capacity, medical expenses, lost earnings, loss of consortium and loss of enjoyment of life.

Pettigrew is represented by Edward J. Womac, Jr. of New Orleans-based Edward J. Womac, Jr. and Associates.

The case has been assigned to Division G Judge Robert A. Pitre, Jr.
