NEW ORLEANS – A Utah man has filed suit against a medical equipment manufacturer alleging wrongful termination.
Jonathan Manley filed suit against Advanced Neuromodulation Systems, Inc. in the Orleans Parish Civil District Court on June 29.
Manley claims he entered into an employment contract on May 25, 2011 as a sales representative with Advanced Neuromodulation Systems, a manufacturer involved in the production of deep brain stimulator devices.
The plaintiff alleges that on April 2, 2012 the defendant terminated him from his position despite having signed a two year contract with him previously.
Manley asserts that the defendant did not disclose FDA warnings surrounding the product which he would be selling. Further the plaintiff claims the defendant decided to drop the deep brine stimulator from its sales line after deciding not to submit its system for approval to the FDA for fear of inspection.
Manley claims he was lured away from employment with the defendant's only competitor in the deep brain stimulation field, Medtronic.
The defendant is accused of interfering in the employment relationship between Manley and Medtronic in order to obtain a competitive advantage over Medtronic.
An unspecified amount in damages is sought for back payment of wages.
Manley is represented by Metairie-based attorney Jeffrey K. Warwick.
The case has been assigned to Division J Judge Paula A. Brown.
