Truck driver sues food distributor claiming injury when overhead door fell on him

GRETNA – A Delaware man is suing a Harahan food distributor for injuries he claims to have received when making a truck delivery.

Samuel Ellers filed suit against Reinhardt Foodservice Lousiana LLC and Lone Oak-Harahan LLC in the 24th Judicial District Court on July 10.

Ellers claims he was employed as a truck driver and making a delivery to Reinhardt at their 918 Edwards Ave. location in Harahan when an overhead door fell on him. The plaintiff alleges he was injured in the incident.

The defendant is accused of allowing a dangerous condition to exist, failing to inspect for a dangerous condition, failing to provide a safe place of business, failing to remedy conditions that were unreasonably dangerous, violation of laws, knowing of the defect, not exercising reasonable care, neglecting to repair defects, creating a dangerous condition, failing to warn business invitees of the dangerous condition and failing to maintain the premises in a safe condition.

An unspecified amount in damages is sought for al forms of general damage and all forms of special damage recognized by the laws of the state of Louisiana.

The case has been assigned to Division G Judge Robert A. Pitre Jr.
