Winn-Dixie shopper sues after slipping and falling

NEW ORLEANS - A Winn-Dixie shopper has filed a lawsuit against the store that claims she suffered serious injuries when she slipped on the wet floor and fell.

Regina Woods-Errico filed suit against Winn-Dixie Montgomery d/b/a Winn-Dixie and XYZ Insurance Co. on May 24 in Jefferson Parish District Court. The defendant removed the case to federal court in New Orleans on July 3.

The alleged incident occurred on Sept. 25, 2011 while Woods-Errico was a customer at the Winn-Dixie store located in River Ridge. She states she was shopping and slipped on a wet substance. Woods-Errico fell to the ground and allegedly suffered serious injuries.

The defendant is accused of negligence for failing to properly maintain its premises, failing to warn their guests of known hazards/dangerous conditions, failing to adequately inspect property or premises, placing their guest in perilous situation by lack of inspection or maintenance, creation of a known defective/hazardous condition, failing to properly oversee their employees, and for failing to correct a known hazardous/defective condition.

Woods-Errico is seeking damages for physical and mental pain and suffering and disability, medical expenses, scarring, disfigurement, interest, and court costs.

The plaintiff is represented by New Orleans attorneys John D. Sileo and Kevin P. Richel.

U.S. District Judge Nannette Jolivette Brown is assigned to the case.
