Zimmer sued for allegedly providing wrong device for man's knee replacement

NEW ORLEANS - A Lafourche Parish couple has filed a lawsuit against Zimmer Solutions, the manufacturer of knee replacement devices, for allegedly providing wrong parts.

Randy J. Landry and Karen Landry filed suit against Zimmer Inc. a/k/a Zimmer Solutions on Aug. 7 in federal court in New Orleans.

Randy Landry underwent left knee total replacement on Dec. 7, 2011 at the Ochsner St. Anne Hospital in Lafourche Parish. He states that a Zimmer representative provided various boxes of medical devices including devices for a right knee implant. Zimmer allegedly represented that the four boxes contained the appropriate parts.

Landry is asking for an award of $1 million in damages for pain, suffering, disability, mental anguish, medical expenses, lost wages, loss of impaired earning capacity, scars, disfigurement, loss of the ability to pursue any gainful occupation and to enjoy life, consortium damages, loss of sleep and emotional damages, interest, and court costs.

The plaintiffs are represented by James M. Funderburk, Stanwood R. Duval, C. Berwick Duval II and Kathryn W. Richard of Duval, Funderburk, Sundberry, Lovell & Watkins in Houma. A jury trial is requested.

U.S. District Judge Jane Triche Milazzo is assigned to the case.
