GRETNA – A Jefferson Parish woman is suing a local performing arts group for its alleged mishandling of health insurance funds following her termination from the theater.
Linda Jumonville filed suit against Rivertown Repertory Theatre Guild, Inc. in the 24th Judicial District Court on Aug. 8.
Jumonville claims that after she was fired from her job at the theater on March 28, 2012 she continued to pay monthly health insurance premiums to continue her coverage for up to 12 months as provided for by state law. The plaintiff alleges she forwarded checks for the health insurance premiums to her former employer who was then supposed to provide payment to the insurer. Jumonville asserts that despite sending a check by certified mail that was cashed her health insurance benefits were terminated on March 31, 2012 after the defendant allegedly did not provide the insurer with payment.
The defendant is accused of failing to provide continued health insurance as required under state law, breach of contractual obligation, fraud, negligence, converting payments made to the insurer to their own accounts, enrichment without cause and detrimental reliance by making the plaintiff believe she had health insurance when she did not.
An unspecified amount in damages is sought for medical expenses, cost of health insurance, general damages, loss of enjoyment of life, lost wages and attorney's fees.
