NEW ORLEANS - A Picayune, Miss. couple is suing several entities for allegedly ignoring unsafe work conditions that resulted in one of them sustaining injuries.
Jack and Dorothy Sollberger filed a lawsuit against Southland Truck Leasing, L.L.C., Heavy Haulers Inc. and Pontchartrain Materials Corporation, L.L.C. (PMC) in the Orleans Parish Central District Court on Aug. 3.
Jack Sollberger, a former truck driver for PMC, claims that after notifying all three defendants of a malfunctioning truck seat, he was still required to use the same truck without the seat working properly. He alleges that as a result of the seat moving up and down, not safeguarding him from vibration, shocks, and bumps in the road, he suffered serious bodily injury to his spine, nerves, muscles, etc.
Mrs. Sollberger is alleges she has experienced a loss of consortium as a result of her husband's injury for which they claim the defendants are responsible.
The defendant is accused of wrongful action including, but not limited to, failure to properly repair the truck seat, allowing the petitioner to continue using an improperly working truck seat, gross negligence, intentional failure to warn and intentional tort.
An unspecified amount is sought for all damages including: medical expenses, pain and suffering, mental anguish, loss of wages, loss of enjoyment of life and any other damages found reasonable at trial.
The plaintiffs are represented by New Orleans-based attorney Jeffrey T. Greenberg.
The case has been assigned to Division G Judge Robin M. Giarrusso.
