BATON ROUGE – A Wal-Mart customer is suing after tripping and falling on a grape last year at the store located at 3132 College Dr.
Claire Juvenal filed suit against Wal-Mart Louisiana, LLC and Wal-Mart Stores, Inc. in the 19th Judicial Court on Aug. 3.
The defendant is accused of failing to use reasonable care to keep the premises clean, failing to keep the premises free of hazardous conditions, failing to warn customers of potential unsafe conditions, having constructive or actual knowledge and not removing or warning of a hazardous condition and allowing grapes to remain on the floor of the store.
An unspecified amount in damages is sought for pain to plaintiff's left knee, physical pain and suffering, mental anguish and pain, medical expenses, loss of enjoyment of life and lost wages.
The plaintiff is represented by Scott M. Emonet of the Baton Rouge-based Murphy Law Firm.
The case has been assigned to Division M Judge Kay Bates.
