BATON ROUGE – A Baton Rouge man is suing an ice cream franchise for alleged injuries he suffered from falling on the premises.
Cleatter Moore filed suit against Baskin-Robins Franchised Shops, LLC, Baskin-Robins Franchising, LLC and its insurance company in the 19th Judicial Court on Aug. 9.
The plaintiff claims he was leaving the Baskin Robins located at 1839 Staring Lane on Sept. 8, 2011 when his foot got caught in a pothole in the walkway. Moore alleges he subsequently fell and was injured.
The defendant is accused of failing to use reasonable care to keep the premises clean and safe, failing to keep the premises free of hazardous conditions, failing to warn of potential unsafe conditions, having constructive or actual knowledge, not removing a hazardous condition and failing to warn of a hazard.
An unspecified amount in damages is sought for head, neck, back, face, scalp and right knee injuries, physical pain and suffering, mental anguish and pain, medical expenses, loss of enjoyment of life and lost wages.

The case has been assigned to Division A Judge Todd Hernandez.
