Dumpster company sued after dumpster allegedly falls on man's foot

BATON ROUGE – A Baton Rouge man has filed suit against a waste service company for an alleged dumpster malfunction.

Jeffrey Ponder filed suit against the SDT Waste & Debris Services, LLC, Progressive Waste Solutions of La. Inc. and its insurance company in the 19th Judicial Court on Aug. 14.

The plaintiff was allegedly at his place of employment, Stroubes, located at 107 3rd St., when he was rolling the dumpster owned by the defendant. He claims the wheels fell off and the dumpster fell, causing injuries to his left foot.

The defendant is accused of failing to use reasonable care to keep the premises in a clean and safe condition, failing to warn of potential unsafe conditions and having constructive or actual knowledge and not properly warning of the hazardous condition.

An unspecified amount in damages is sought for physical pain and suffering, mental pain and anguish, medical expenses, loss of enjoyment of life and loss wages.

The case has been assigned to Division M Judge Kay Bates.
