Lucky Law Firm sued by woman claiming injuries in trip and fall incident

BATON ROUGE – A Baton Rouge woman filed suit against a personal injury law firm for injuries that allegedly occurred on its premises.

Priscilla Smith filed suit against The Lucky Law Firm, P.L.C. and Cypress Credit Inc. in the 19th Judicial Court on Aug. 15.

The plaintiff claims that on Aug. 16, 2011, she was entering the firm when she was forced to step around an open storm door because the door opened outward onto the entry steps. She asserts she fell off a five-inch drop, and suffered a broken ankle. Smith has since then allegedly had multiple surgeries to install plates and screws in her ankle and was at one time confined to a wheelchair and had to rely on home health services.

The defendant is accused of failing to maintain the leased premises, failing to warn its invitees of the defect and failing to remedy or block off the defective area.

An unspecified amount in damages is sought for pain and suffering, medical expenses, loss of enjoyment of life and general damages.

Smith is represented by Neil D. Sweeney of Sweeney Law Firm, LLC.

The case has been assigned to Division D Judge Janice Clark.
