NEW ORLEANS - A Louisiana worker has filed a lawsuit against Cargill claiming he suffered serious injuries when a man-lift/elevator he was aboard malfunctioned causing it to fall an unknown distance at a rapid rate.
Claiming he was not warned of the unreasonably dangerous condition of the elevator, Warren Lewis filed the suit on Oct. 17 in federal court in New Orleans.
The alleged incident occurred on July 11, 2012 as Lewis was working in man-lift/elevator that was descending to the ground, when the elevator cables broke or the elevator malfunctioned. The elevator fell an unknown distance at a rapid rate, then suddenly stopped and Lewis suffered injuries to his neck, back and legs.
The defendant is accused of strict liability and negligence for failing to inspect and maintain the elevator and its cables, failing to warn Lewis of its unreasonably dangerous condition, which was not obvious or known to him.
The plaintiff is seeking an award of damages for loss of wage earning capacity, disability, pain and suffering, mental anguish, loss of wage earning capacity, medical bills, interest, and court costs.
Lewis is represented by Stephen J. Johnson in Houma.
U.S. District Judge Carl J. Barbier is assigned to the case.
