NEW ORLEANS - An Orleans Parish woman has filed a lawsuit against Church's Chicken that claims she slipped and fell due to a lack of warnings signs on a recently mopped floor.
Ella Crosby filed suit against Cajun Operating Co. and ABC Insurance Co. on Aug. 1, 2012 in Orleans Parish District Court. The defendant removed the case to federal court in New Orleans on Sept. 27.
The alleged incident occurred on Aug. 1, 2011 as Crosby was a patron at the Church's Chicken located at Chef Menteur Highway in New Orleans. She states that she slipped and violently fell to the floor because one of the defendant's employees recently mopped the floor and left a standing puddle of water unattended.
There were no warnings around the area where the unattended puddle of water was located on the floor.
The defendant is accused of negligence for failing to maintain a safe business environment, failing to warn of a hazardous condition on the floor, failing to see what should have been seen, failing to exercise necessary caution and due care, failing to clean the area properly, and for maintaining the premises in a careless and reckless manner.
The plaintiff is seeking an award of damages for mental anguish, emotional trauma, emotional distress, physical pain and suffering, loss of pursuit of happiness, loss of enjoyment of life, loss of support, love, affection, and society, medical expenses, attorney's fees, and court costs.
Crosby is represented by Pius A. Obioha, Michal J. Harris and Kelly S. Love of Law Offices of Pius A. Obioha & Associates in New Orleans. A jury trial is requested.
U.S. District Judge Jane Triche Milazzo is assigned to the case.
