BATON ROUGE – A Rapides Parish woman is suing a hotel after she allegedly fell in the lobby.
Candice Cheney filed suit against Century Wilshire, Inc., also known as Holiday Inn Baton Rouge, and Hanover Insurance Company in the 19th Judicial Court on Nov. 9.
The plaintiff claims she tripped and fell on Nov. 6, 2011 at Holiday Inn Baton Rouge South located at 9940 Airline Hwy in Baton Rouge. She asserts she was attending a union convention that was held at the hotel. Cheney states she was walking in the lobby of the hotel, when she suddenly tripped because the floor was raised and the carpeting was torn. The plaintiff stresses the accident was caused solely and proximately by the negligence and fault of Century, its agents, servants and employees.
The defendant is accused of negligence, failing to maintain safe premises for visitors, creating and maintaining a dangerous condition in the lobby of the hotel where they knew or should have known guests would be walking, failing to provide signs, warnings or indicators that would notify and alert visitors and guests that a change in elevation of the floor existed and the carpet was torn and creating an unreasonable risk of harm by allowing a dangerous condition to exist.
An unspecified amount in damages is sought for injury to both her knees, bruises, contusions and strains to her knees and other body parts, medical expenses, loss of enjoyment of life, physical pain and suffering and mental anguish, anxiety, humiliation and embarrassment.
