Winn-Dixie sued by woman claiming she slipped and fell

NEW ORLEANS – A woman shopping at the Winn-Dixie on Chef Menteur Highway in Orleans Parish claims she slipped and fell on the premises and is suing for damages.

Benitta Wesco filed a lawsuit against BI-LO Holdings, LLC, Winn-Dixie Montgomery, LLC, and ABC Insurance Company in the Orleans Parish Central District Court on Aug. 24. Wesco claims that while walking down the aisle of the Winn-Dixie grocery store she slid on a liquid substance on the floor and fell down. As a result of this fall Wesco alleges she suffered severe emotional distress and personal injuries to her lower back, shoulder, neck and wrist.

The defendant is accused of failure to keep the store in a clean manner, failure to keep the aisles, passageways, and floors in a reasonable safe condition and failure to warn patrons of the impending dangers.

The plaintiff does not specify an amount but is seeking full compensation for pain and suffering and medical bills.

Wesco is represented by James Carter of New Orleans-based James Carter & Associates, LLC.

This case has been assigned to Division M Judge Paulette R. Irons.
