Gas station sued by woman after pump hose allegedly broke and spewed gas on her

GRETNA – A Jefferson Parish woman is suing a gas station after the hose on a pump she was using allegedly broke and spewed gas all over her and her vehicle.

Joan Antoine filed suit against Danich, Inc., Khawaja Javed Hussain, Zavid Hussain and their insurer in the 24th Judicial District Court on Oct. 25. Antoine claims she was pumping gas at the Shell Service Station located at 101 Westbank Expressway when the hose to the pump she was using burst. The plaintiff alleges that she had was distraught by the incident given that she had two young children in the car at the time and was fearful that a spark may set her and the car on fire, especially when the defendants made her start and move her car so they could clean up the gasoline.

The defendant is accused of failing to maintain its premises in a safe condition, failing to have adequate inspection and maintenance procedures in place, maintaining a condition it should have known was inherently dangerous, permitting an unsafe condition, failing to warn of the unsafe condition and failing to enact proper safety rules and regulations.

An unspecified amount in damages is sought for pain and suffering, mental anguish and medical expenses.

Antoine is represented by Edmond J. Harris of New Orleans-based Valteau, Harris, Koenig & Mayer.

The case has been assigned to Division D Judge Robert M. Murphy.
