NEW ORLEANS – A Jefferson Parish woman is suing a New Orleans bar for injuries she claims to have received when she tripped on a barricade in front of the establishment.
Patrice Smith filed suit against Walk-on's Bistreaux & Bar New Orleans, LLC in the Orleans Parish Civil District Court on Oct. 1.
Smith claims she was walking in front of Walk-on's Bistreaux & Bar during when she tripped on a barricade and fell to the ground. The plaintiff alleges that she received injuries in the fall, particularly to her right foot. Smith asserts that the area was congested at the time due to a National Football League game that was taking place nearby and that is why the barricade was erected by the defendant. The plaintiff claims that if the defendant had used flatfooted barricades rather than bridge-footed barricades she likely would not have fallen.
The defendant is accused of using a barricade with a bridge foot in a congested area as opposed to a flat footed barricade in thereby creating a risk, strict liability, failing to warn and negligence of its employees.
An unspecified amount in damages is sought for mental pain and suffering, physical pain and suffering, wage loss, permanent scarring, disability, medical expense and loss of enjoyment of life.

The case has been assigned to Division C Judge Sidney H. Cates, IV.
