NEW ORLEANS – An international insurance company is suing a New Orleans demolition company for not providing the proper paperwork for an insurance plan and thus paying a smaller premium than should have been required.
Western World Insurance Company filed suit against Louisiana Demolition, Inc. in the Orleans Parish Civil District Court on Sept. 26. Western World Insurance Company claims Louisiana Demolition, Inc. signed up for insurance coverage with the understanding that it would provide insurance documents for any subcontractors working on job sites. The plaintiff claims that after an audit of the insurance contract it found the defendant never provided the required insurance proof for the sub-contractors and thus owed a higher premium than what was first submitted.
Western World Insurance asserts that it made formal demand for the required documents and did not receive a response from the defendant.
The defendant is accused of breach of contract.
Damages in the amount of $33,936 are sought for the entire insurance premium the plaintiff claims they are owed.
Western World Insurance Company is represented by Richard B. Levin of the Metairie-based Levin Law Offices.
The case has been assigned to Division D Judge Lloyd J. Medley.
Case no. 2012-09124.
