NEW ORLEANS – An Orleans Parish resident is suing a Louisiana-based home personal care attendant service over a slip and fall incident in her own home.
Odessa Griffin filed a lawsuit against Psalms 23 DME, LLC d/b/a Divine Inspirations PCA Services in the Orleans Parish Central District Court on Sept. 14. Griffin claims that the attendant, provided by the defendant, failed to answer her call to assist her in traversing to the bathroom in her home.
The attendant’s alleged negligence resulted in the plaintiff getting up and going to the bathroom by herself. According to the suit, the attendant had recently mopped the bathroom, unbeknownst to the plaintiff, and the floor was still wet. Griffin entered the restroom and slipped and fell sustaining a fractured left hip and other harm.
The defendant is accused of failing to provide reasonable and necessary attendant care in conformity with the care plan that was established for petitioner, failing to provide assistance with ambulation to petitioner, failing to respond to petitioners beckoning for assistance to go to the bathroom and all other acts of negligence to be learned at trial.
The plaintiff is seeking compensation in the excess of $50,000 for all damages incurred and any other found reasonable in the premises.
