West Bank Dillard’s sued by woman who allegedly fell in “oily substance”

GRETNA – A Jefferson Parish woman is suing a department store for injuries she claims to have received injuries in a fall at a department store.

Wendy Falcon filed suit against Dillards Department Stores, Inc. and an unknown store employee in the 24th Judicial District Court on Oct. 27.

Falcon claims she was shopping at the Dillard's located at 197 Westbank Expressway in Gretna when she slipped in an oily substance and fell to the floor. The plaintiff alleges that in the fall she received severe personal injuries to her body including to her muscular, skeletal and nervous systems.

The defendant is accused of allowing a slick to substance to remain on the floor, failing to remove the hazard, failing to properly maintain the floors of the premises, failing to oversee the premises properly, failing to inspect or clean the danger, failing to warn others of the danger and failing to take precautionary steps to remedy the danger.

An unspecified amount in damages is sought for injury, medical costs and lost wages.

Falcon is represented by Arthur O. Scott, III of New Orleans-based Riguer Silva, LLC.

The case has been assigned to Division C Judge June Berry Darensburg.
