Winn-Dixie sued after woman trips over pallet jack

GRETNA – A New Orleans woman is suing a Metairie grocery store for injuries she claims to have received on their premises.

Johnette Mistretta filed suit against Winn-Dixie Montgomery, LLC and its insurers in the 24th Judicial District Court on Oct. 30. Mistretta claims she was shopping at the Winn-Dixie located at 212 Veterans Blvd. in Metairie when she tripped over a pallet jack and fell to the ground. The plaintiff alleges that she received severe and disabling injuries as a result of the incident.

The defendant is accused of failing to maintain its premises, failing to warn guests of hazard, failing to adequately inspect property, placing  guests in perilous situations due to lack of inspection, creating a hazard, failing to properly oversee employees and failing to correct a hazardous defect.

An unspecified amount in damages is sought for mental pain and suffering, disability, scarring, disfigurement, lost wages and loss of future earnings.

Mistretta is represented by attorney John D. Sileo of New Orleeans.

The case has been assigned to Division C Judge June Berry Darensburg.
