Shifting stairs and termite penetration lead to suit

NEW ORLEANS – A local Orleans Parish contractor and structural engineering firm are being sued after their work on a Colbert Street residence in New Orleans allegedly began to show signs of deterioration.

Amy and Kelly Burke filed a lawsuit against Atherton Construction, LLC and Grieshaber Consulting in the Orleans Parish Central District Court on Oct. 29. The plaintiffs claim exterior stairs on their residence began breaking away in February 2012 and termites began penetrating through the termite barrier through cracks that had developed to the point where the stairs were separating from the residence.

The defendant is accused of breach of contract and negligence.

An unspecified amount is sought for property damages, loss of use and enjoyment of property, additional living expenses, diminution of value in property and inconvenience.

The plaintiff is represented by Michael S. Brandner, Jr of Brandner Law Firm, LLC.

This case has been assigned to Division M Judge Paulette R. Irons.

Case no. 2012-10182.
