Plaintiffs Allege Fraudulent Practices by Medical Equipment Companies Over Misleading Sales Tactics

Rebecca A. Davis and her business, Rebecca A Davis FNP-C, LLC, have filed a lawsuit against multiple companies alleging fraudulent practices in equipment sales and financing. The complaint was filed on April 23, 2025, in the United States District Court for the Middle District of Louisiana against BTL Industries, Inc., Cynosure, Inc., First Federal Bank and Trust, Stearns Bank NA, Greenwoods Equipment Finance LLC, Me and My Pal Inc., MMP Capital LLC, and Banleaco Inc.

The plaintiffs allege that BTL Industries used deceptive practices to sell medical equipment to Davis's practice. According to the complaint, BTL representatives approached Davis in November 2022 with promises that purchasing their aesthetic systems would significantly increase her revenue without involving insurance billing. The lawsuit claims that BTL misrepresented the financial benefits of purchasing their equipment and arranged for multiple loans from different lenders to finance these purchases under misleading terms. "BTL submitted multiple loan applications to different lenders," the complaint states, suggesting this was done to circumvent Davis's inability to qualify for a single large loan.

Davis further accuses BTL of failing to deliver on promised incentives such as training center designations and advertising support which were crucial for generating expected income from the purchased equipment. The complaint details how these unfulfilled promises led to financial strain on Davis's practice as she struggled with mounting debt obligations exceeding $1 million. Additionally, the lawsuit alleges that BTL’s monopoly over certain aesthetic devices in the U.S. market allowed them to manipulate pricing unfairly.

The plaintiffs are seeking rescission of all contracts related to the equipment purchases and loans due to fraud and misrepresentation by the defendants. They also seek damages exceeding $75,000 along with treble damages under Louisiana’s Unfair Trade Practices Law for deceptive business conduct. Furthermore, they request compensation for emotional distress suffered by Ms. Davis due to these transactions.
