GRETNA – A Jefferson Parish woman is suing a national retail corporation for injuries she allegedly received at one of their local stores.
Sylvia Childress filed suit against Richards Clearview, LLC, Indian Harbor Insurance Company and Target Corporation in the 24th Judicial District Court on Nov. 3. Childress claims she was in the parking lot of the Target located at 4436 Veterans Blvd. in Metairie when she allegedly tripped over a piece of rebar protruding from a broken concrete parking stop and fell to the pavement. The plaintiff alleges that she seriously injured herself in the incident including injuries to her entire body and particularly to her wrist that required surgery.
The defendant is accused of failing to maintain a safe condition, failing to fix the dangerous condition, failing to warn the plaintiff, failing to place signs notifying the plaintiff of the defective condition and failing to prevent the plaintiff from entering the area.
An unspecified amount in damages is sought for pain and suffering, medical expenses, loss of earning capacity, loss of enjoyment of life, loss of income, mental anguish and permanent impairment and disability.
Childress claims that Indian Harbor Insurance Company has already agreed to a settlement of $82,500, but Medicare has placed a lien on the decision because the program has not yet received the necessary amount of money to satisfy their final demand.

The case has been assigned to Division I Judge Nancy A. Miller.
