Woman sues food bank after allegedly falling over box

GRETNA – A Jefferson Parish woman is suing a local food bank after she fell over a box and injured herself.

Virginia Stewart filed suit against Second Harvest Food Bank of Greater New Orleans and Acadiana, Bridge City Community Center, JeffCap Community Centers, the Parish of Jefferson and American Alternative Insurance Corporation in the 24th Judicial District Court on Dec. 6. Stewart claims she was carrying boxes at the Bridge City Community Center for Second Harvest Food Bank when she tripped over a box in a walkway. The plaintiff alleges she hit her head on the floor and leg on a curb when she fell.

The defendant is accused of failing to warn of the danger, failing to timely and appropriately pick the box up, failing to block off the danger, failing to adequately inspect the premises, failing to adequately oversee people responsible for maintaining the premises and failing to meet general standard of care.

An unspecified amount in damages is sought for medical expenses, physical pain and suffering, mental and emotional pain and suffering, loss of enjoyment of life, permanent physical disability, inconvenience, legal interest, court costs and attorney’s fees.

Stewart is represented by David J. Mitchell of the New Orleans-based Law Offices of Frank J. D’Amico.

The case has been assigned to Division M Judge Henry G. Sullivan.
