Winn Dixie sued by elderly man who was allegedly injured in slip in water

GRETNA – A Jefferson Parish man is suing a local outlet of a national grocery store chain for injuries he allegedly received on their premises in a slip and fall incident.

Elias Ned and his wife Betty filed suit against Winn Dixie Louisiana Inc. and its insurer in the 24th Judicial District Court on Dec. 13. Ned claims he went to the Winn Dixie located at 3623 Jefferson Hwy. in Jefferson with his grandson and that as he proceeded through the aisles with a shopping cart he slipped in a puddle of water. The plaintiff alleges he was left on the floor after the fall while a cashier summoned the store manager and when the store manager appeared he only told the plaintiff that he needed to go to the hospital and did not provide any further help. Ned asserts his grandson took him to a nearby hospital following the incident and that his wife requested an incident report from the store manager. Ned alleges he received severe pain and injuries, including emotional suffering, in the fall.

The defendant is accused of failing to safely operate the store, allowing a hazard to exist in the path of customers, failing to exercise reason and diligence, disregarding the specific and obvious dangers on the date of the accident, failing to exercise diligence in their supervision of the plaintiff at the time of the injury and failing to exercise diligence to ensure the plaintiff received medical attention.

An unspecified amount in damages is sought for physical pain and suffering, mental pain and suffering, emotional distress, medical expenses and loss of consortium.

Ned is represented by New Orleans-based attorney Christopher Martin Utley.

The case has been assigned to Division N Judge Carolyn W. Gill-Jefferson.
